Please read these Terms of Service carefully before using SparkLine. These terms govern your use of our platform and services.
Acceptance of Terms
By accessing or using the SparkLine platform and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing SparkLine. These terms apply to all users, visitors, and others who access or use the service.
Use of the Platform
You may use SparkLine only for lawful purposes and in accordance with these Terms. You agree not to use the platform in any way that violates applicable laws, infringes on the rights of others, is fraudulent or deceptive, or interferes with the proper functioning of the service. You are responsible for all activity that occurs under your account.
Account Registration
To access certain features of SparkLine, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for any activity under your account. Notify us immediately of any unauthorized use.
Intellectual Property
SparkLine and its original content, features, and functionality are and will remain the exclusive property of SparkLine Influencer Marketing and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SparkLine.
Creator & Campaign Content
You retain all rights to content you submit through the platform. By submitting content, you grant SparkLine a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content solely for the purpose of providing the services. You represent that you have all rights necessary to grant this license.
Payments & Billing
SparkLine offers the following plans: Starter (free, 5 creator lookups per rolling 30-day period), Pro ($49/month, 50 lookups), Agency ($99/month, unlimited lookups), and Pay Per Campaign ($9.99 one-time, single full analysis). Paid plans are processed through Whop. By subscribing, you authorize recurring charges to your payment method at the applicable rate. Lookup limits reset on a rolling 30-day cycle from the start of your billing period. All fees are non-refundable except where required by law. We reserve the right to modify pricing with 30 days' notice.
Disclaimers
SparkLine is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. We make no guarantees regarding campaign performance, creator availability, or ROI outcomes.
Limitation of Liability
To the fullest extent permitted by law, SparkLine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
We may terminate or suspend your account and access to the platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the service will cease immediately.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
